Residential Pool Closing Terms & Conditions
Barton Pool Company herein known as/referred to as “Company”.
1. Closing Services as per work described/selected on Closing Contract. Company will not be expected to perform any work other than that which is herein contracted. Company cannot be held responsible for damages created by other persons.
2. Water/Excess debris from top of cover must be removed before service visit may take place. If an additional trip/time is required, Customer will be billed additionally on a time and materials basis.
3. Company is not responsible for any items under the care of the homeowner during winter months.
4. All damaged or corroded parts not fit for reuse will be replaced and billed to the homeowner within $100 threshold. Company must have access to closing items removed from the pool structure/pool equipment when pool was opened. Any missing plugs or winterizing materials will be replaced at normal retail prices.
5. At closing, Company will not be expected to be responsible for any missing or damaged items of pool equipment, stored on Owner’s property under their care and keeping, over the summer months.
6. Company must have access to property, pool/pool equipment area, outside working electrical outlets, and outside working water spigots. These outlined working conditions not met may incur return trip fees at normal service rates.
7. Company is not responsible for draining pool and/or spa to closing height within reason/timely accommodation.
8. If pool equipment is inside the home, homeowner must be home for entire pool closing.
9. Company will not be held responsible and/or liable for damages or added expense for delays of contract date caused by shortages including but not limited to; availability of parts, accessories, weather conditions, strikes, acts of God or other circumstances beyond the control of Company. Service/repair work to complete the closing may be rescheduled at our earliest convenience.
10. If company cannot finish closing on first attempt, a return visit fee of $100 will apply when we return to finish closing the pool/spa plus materials, if materials are needed.
11. Due to circumstances outside Company’s control, Company does not warranty pool service work or make an expressed or implied warranty of pool structure, deck, piping or any associated pool equipment. Potential repairs must be completed by Company. No compensation for repairs will be granted for work performed by others.
12. Company does not assume responsibility and/or liability for damages to lawns, shrubbery, landscaping/hardscape including potential run-off to neighboring properties, due to backwashing, draining, and/or cleaning filter or due to antifreeze or chemicals from closing processes or the pool water.
13. Automation probes will be removed and capped with saline solution. Homeowners must keep probes indoors in a warm area during the winter season. Homeowner is to provide instructions on where to leave probes.
14. Filter cartridges will be removed from the filter and lightly sprayed down with garden hose. Cartridges will be left near the equipment pad, unless homeowner provides instructions on where to leave them before scheduled appointment takes place.
15. Any changes/amendments to this agreement must be made in writing, constitute the entire contract of the parties, and be signed by both parties to be binding. This contract shall not be binding until Company receives a signed contract. Company reserves the right to terminate this contract at any time.
16. Closings outside our 15-mile service radius will incur a $35 travel fee.
