Commercial Pool Closing Terms & Conditions

Barton Pool Company herein known as/referred to as “Company”.

The Commercial Property herein known as/referred to as “Property”.

  1. Opening Services as per work described on Opening Contract. Company will not be expected to perform any work other than that which is herein contracted. Company cannot be held responsible for damages created by other persons.
  2. Water/Excess debris from top of cover must be removed before service visit may take place. If an additional trip/time is required, Customer will be billed additionally on a time (billed at standard labor rates) and materials basis.
  3. Water level must be raised to standard operational level (mid-skimmers).
  4. Drain and Cleans are excluded from raising water level.
  5. Drain and Cleans require a signed Release of Liability Waiver.
  6. Company is not responsible for any items under the care of the property owner during winter months. All damaged or corroded parts not fit for reuse will be replaced and billed to the property owner within $150 threshold. If the Company cannot finish opening, standard labor rates will be assessed when we return to finish opening the pool.
  7. Company must have access to (gate key, codes, any other applicable): property, pool/pool equipment area, outside working electrical outlets, and outside working water service. If these outlined working conditions are not met, a rescheduling fees of $95 will apply and scheduled at Company’s earliest convenience.
  8. Company is not responsible to fill pool and/or spa to operational level. If the water level is not at operational level a rescheduling fee of $95 will apply.
  9. Company must have access to items removed from the pool structure and pool equipment when pool was winterized.
  10. If pool equipment is indoors, property management must be present for the entire pool opening.
  11. Company will not be held responsible and/or liable for damages or added expense for delays of contract date caused by shortages including but not limited to; availability of parts, accessories, etc. or weather conditions, strikes, acts of God or other circumstances beyond the control of Company or for any ensuing damage and/or operational expense caused by said delays. Service work to complete the opening may be rescheduled at our earliest convenience.
  12. Due to circumstances outside Company’s control, Company does not warranty pool service work or make an expressed or implied warranty of pool structure, deck, piping or any associated pool equipment.
  13. Company will not assume responsibility and/or liability for damages to lawns, shrubbery, landscaping/hardscape including potential run-off to neighboring properties, due to backwashing, draining, and/or cleaning filter due to antifreeze or chemicals from the pool.
  14. At opening, Company will not be expected to be responsible for any missing or damaged items of pool equipment, stored on Owner’s property under their care and keeping, over the winter months.
  15. This contract shall not be binding until Company receives a signed contract. Company reserves the right to terminate this contract at any time.
  16. Opening water conditions may dictate pool(s) to be fully drained and pressure/acid washed. These services are not included here and will be separate estimates if needed or requested. Please know the status of your pool and request the proper service needed.
  17. Any changes or amendments to this agreement must be made in writing, constitute the entire contract of the parties, and be signed by both parties to be binding.
  18. Company does not guarantee clear bodies of water at the time of opening unless a drain and clean was performed (providing fill water quality is adequate).
